A Fayetteville attorney recently faced serious consequences after admitting to using artificial intelligence (AI) to draft a court filing. This occurred just weeks before a federal jury found him liable in a multimillion-dollar case involving racketeering and fraud. The incident has sparked discussions about the ethical implications of AI use in legal proceedings.

The Case Against Tony Pirani

The jury ruled in favor of a Springdale personal injury law firm, determining that attorney Tony Pirani was involved in a scheme that utilized "runners" to recruit wrongful death plaintiffs from funeral homes. Despite this ruling, Pirani has denied any knowledge of participating in a conspiracy or fraudulent activities.

During a pretrial conference on July 11, Pirani admitted to using AI to draft a motion he filed and electronically signed. However, the filing contained citations and quotes from non-existent cases, which led to significant backlash from the court.

Judicial Reaction and Potential Sanctions

District Judge Timothy L. Brooks described Pirani’s actions as a “flagrant violation of the rules of the court.” He stated that Pirani would need to explain why additional sanctions, including fines or a referral to the Arkansas Judiciary Office of Professional Conduct, should not be imposed.

Pirani referred to his actions as an "egregious mistake" in another court filing. Although he took full responsibility for the errors, he explained that they were made in an effort to comply with court orders and deadlines.

"I was terrified of missing a deadline for pre-trial motions, and I did attempt to use AI to assist with that. Not for the writing of the motions. The arguments, the work, the subject matter of the motions were all mine," Pirani said. He expressed deep regret and embarrassment, emphasizing his 20 years of practice and the reputation he built in the community.

Personal Circumstances and Challenges

Pirani also highlighted his challenging personal circumstances. He mentioned that he is a solo practitioner without any support staff or legal and administrative help. Additionally, he had recently returned from extended medical leave due to a life-threatening illness.

A doctor’s letter dated October 4, 2024, indicated that Pirani might require workplace accommodations for up to six months. According to court filings, he resumed full-time duties in June. However, he acknowledged that he should have informed the court earlier about his situation but was optimistic about meeting deadlines.

Pirani filed a motion for a continuance, but the judge denied it. In response, the judge accused Pirani of taking on additional clients and cases during his medical struggles.

"Without trying to minimize the seriousness of your health issues, the reality is, you returned to practice in October and in a more fulsome way in January," the judge remarked. "You have continued to take cases. You have not bothered to associate other lawyers as a means of fulfilling your ethical responsibilities."
